Legal Question in Wills and Trusts in New York

An estate never probated

I have some relatives in New York whose parents passed away in 1991 with no will. The estate was never probated and the home and utilities remain in the parents name. Has this created any liabilities to the heirs living in the parents home?

Re: An estate never probated

the heirs won't be able to transfer title if they ever want to sell. Also, are there other heirs other than the ones occupying the house? They may be being deprived of their part of the estate.
