Legal Question in Wills and Trusts in New York

My father deceased Jan. 9, 2013 and his will was invalid. My brother had him sign the house over to him a year before his passing. My fathers will was invalid. I contested and decided to enter an agreement to not contest the house but for half of anything remaining. My brother cleaned out the house and everything and all that was left was my fathers payout from lung cancer lawsuit. I just found out he defaulted on this agreement so therefore my thoughts this agreement is null and I can sue him for the house and for the monies he kept?
