Legal Question in Wills and Trusts in New York

father died, no will, had debts

My father recently died without a will and with several debts. I am his only next of kin. His only assets would be two older used cars, and a few thousands dollars he has in the bank.

Will I have a problem getting the cars and the money? It's my understanding that if I am appointed administrator of the estate, these will have to go towards paying off the debt. Is there anyway to get them without being administrator of estate?

If the estae is less then $10,000 in value there is a small estate proceeding. Is there anyone else who might be adminstartor?
