Legal Question in Wills and Trusts in New York

My father passed away Oct 30th.

Do the 2 adult children have any legal rights to the fathers affairs?

Father married 6 months before he died. No WILL- Lived in New York City. My father was the Executor to cousins estate that has not been settled yet. What do we do? Thank You, gm

If your father died without a will, the laws of New York apply which sill provide the wife with a certain portion of your father's estate, and the rest will go to his children.

A new executor would have to be appointed for the cousin.
