Legal Question in Wills and Trusts in New York

my husband's estate

He died Dec. 06. I am his estate now (he didn't do a will). After 4 months, his family found an old will in wich he leaves averything to his brother.

Am I still entitle to anything?

Even if the will is valid, you are entitled to file a notice of eloection against the will and take your intestate share.

Note that there is a six month time limit to file this notice of election with the Surrogate's Court.
