myex husband has an apartment in brooklyn, NY andsays that our daughter will inherit it when he dies , but he refuses to write a will. will she inherit it any way as the first born child?

If he dies without a Will, the intestacy statute governs who inherits his estate. If he is not married, all children inherit equally, not just the oldest. If he has more than one child and only wants the oldest to inherit the apartment, he needs a Will.
