Letter of Estate

How can I obtain a letter of estate.

No one seems to know what I am searching for.

You are either requesting Letters of Administration or Testamentary Letters. Assuming the will was probated or an Administrator was appointed for an Intestate Administration, you have to go to the Surrogate's Court and pay the required fee.

That is because no such thing exists in New York. If the decedent died with a will, one petitions for letters testamentary, and if there was no will one petitions for letters of administration.

I agree with the comments of Mark and Mike, that these documents are available from the Surrogate where the Will was probated or the estate is being administered. Your question was a little confusing, as you did not indicate what exactly you were looking for, or why you needed them, or why you might be entitled to them? Are you a named representative, an heir of the decedent, a creditor of the estate or have some other interest in the estate? More information is needed to properly reply to your question.

To obtain letters testamentary or letters of administration (both of which give you legal authority to act for the estate), you must petition the court with either a probate petition or administration probate. Most Court clerks may have forms available for the public.
