Legal Question in Wills and Trusts in New York

how long is too long?

My mother in law passed away 10 weeks ago. My wifes brother is executor of the will. He has not contacted anyone re:administration of the will. He also has not safe guarded the house of personal property of my mother in law. How long is reasonable to wait? What action can my wife take?

The easiest thing to do it is to seek guidance from a lawyer, however, if you wish to avoid the cost of legal fees, you can always consult with a clerk at the Surrogate' s Court.

Has your brother in law given any reason for not probating the will and functioning as executor? If he doesn't want the job he can step aside and let someone else serve as the executor.
