Legal Question in Wills and Trusts in New York

I Believe My Stepmother is Doing Something Illegal

My Dad died 3/2007. Stepmother said he didn't sign a will. Three months later, stepmother gave out $5,000.00 to all 6 children. 4 children are hers; not Dad's. My brother and I are the only blood relatives. She said we will share the rest when she dies. After that, stepmother went to Probate Court. I never got a letter to waive my rights or anything of the sort. Neither did my brother. We have no idea if what she did is legal. We do not even know if we were entitled to more than that. What should we do?

Go to the probate court and retrieve a copy of the file. If it turns out that your signatures for forged or that you were never served, you would be able to file a motion to vacate your stepmother's Letters of Administration.
