Legal Question in Wills and Trusts in New York

Stocks in estate distribution

Dad died 2 yrs ago in ny. He had a will with 3 executors. His assets were real property and stocks. The will did not specify that stocks be distributed to beneficiaries as stock. One of the 3 executors want to sell the stocks instead of transferring title to the beneficiaries at distribution. Does this mean the stocks must be sold?

Re: Stocks in estate distribution

While there is no requirement to distribute assets "in kind", most executors allow the beneficiaries of the estate to make this decision themselves and usually will honor the decision. Those not wanting stock "in kind" usually are equalized as to value on distribution date.
