Legal Question in Wills and Trusts in New York

Do you need to have a Trust any time you have a Will? My mom's lawyer told her she did not and it is expensive, but he is a judge now. Her current Lawyer keeps sending her letters telling her she needs to start a Trust. is this true? The concern she has is that everything will be held up in probate for a long time if anything happens to her.

You can have one without the other. If she is worried about time probate will take there are many options, gifting, various trusts, transfers, adding beneficiaries. She should have further discussions with another attorney who specializes in elder planning.
