Not automatically. Without reading the will of the deceased family member, no one can answer.

The answer to your question will depend on several factors, including whether your husband pre-deceased or post-deceased the other family member; the terms of the will of that family member; whether your husband had a will and, if so, what the terms of the will were; and possibly what assets you have already received from your husband's estate.

The fact that I answer in this way means that there is a lot more information that is needed to answer your question. You need to consult with an attorney. In doing so, you will need to know the dates of death of your husband and of the other family member; information about all family members who survived your husband and the other family member; your husband's will, if any; the other family member's will, if any; and a list of assets of both.

Good luck to you.

I agree with Michael's analysis and that more facts are needed before a definitive answer can be given. This includes a review of the Wills, as well as looking at various dates of death.
