Legal Question in Wills and Trusts in New York

No will or Estate

My brother passed away in December he had no will so I have been taken care of the estate. He has a classic car the title is in his name and there is a lien on it held by my younger brother. The deceased put this on because he was going to file bankruptcy and didn’t want the bank to take his car there was no money passed between the two. Does my younger brother have right to the car or can I sell it to settle his debts.

Re: No will or Estate

I assume that you are the Administrator of your brother's Estate.

Your younger brother can be ordered to remove the lien since it was given without consideration.
