Legal Question in Workers Comp in New York

I am a manager of a temprary staffing agency... I had a irate worker last week, throw a table and chair at me, the table I stopped, but the chair caught my right forefinger and thumb forecing them backwards. I have some damage to the tendant and joints.. severe bruising, and alot of pain associated with it. I did file this as workmans comp, and wasnt sure if I should get a lawyer, since this happened at work and was so violent. I also called thepolice and they said, since the worker left, that they couldnt do anything for me??? they couldnt file a assault charge, and the only thing that could happen was if this worker comes back inside the building.. he could be arrested for tresspass??? I cannotbelieve this person cannot be arrested. I have the whole incident on tape, as my building is equiped with a DVR, and I also have 6 witnesses that saw this happen, unprovoked. What should I do ??
