Legal Question in Workers Comp in New York

My Question is as followes,

If an Employee becomes a Crime Victim in a roberry in his own work place at his offical hours of duty,

and is injured, suffers both physical and mental trauma.

His Employer does not carry any workers compensation insuarance or health insuarance for the employees.

The crime victim has overstayed his visa and does not have a work permit or SSN to work.

In such circumstances how could he obtain compensation for him self from his employer or the state.

I appreciate your advice in this matter.
