Workers compensation statue of limitations

I was hurt at work, i have polio and wear a leg brace and my leg brace broke causing me serious injur. I was told by my boss that this was not a workers comp case as i was not performing my job when i was hurt. i figured she knew what she was talking about and never bothered trying to get a comp attorney. i recived new york state disability. when that ran out i am now on social security. my attorney just advised me that i should look into starting a workers comp claim. but this happened three and a half years ago. i think the limit is three years. but i was misled by my employer. they never opened a case for me when by rights they should have. they know the law and spoke to thr h.r. department and they said the same thing. since i was misinformed by my employer do i have a chance to open a case even after the limitations are over. please help me as i feel that these people knew what they were doing and i am the one out of work and broke since this whole thing happened. my personal injury attorney advised me to look into this as he knows someone who opened a case after five years. thatnk you in advance for any help you may give me.
