Legal Question in Family Law in North Carolina

I have a daughter that is 17 months old and I feel like her father is unfit to see her every weekend, we have a mediation agreement where I get her thru the week and he gets her on the weekends and we split the day of holidays, everytime that i pick her up from him she has a bad diaper rash and a full diaper. He also has a drug problem that involves using needles and he has 2 felonies for manufacturing marijuana, hes also rarely there to pick her up or bring her back its usually his mother. I feel like the only reason he chooses to have anything to do with my daughter is to spite me and because his mother makes him, when we were in a relationship he was very emotionally abusive as well. My question is what chances do I have of obtaining full legal and physical custody of my daughter?

Fairly good based on your description. You will need to consult with a local family law attorney to get the process started. You are also going to want to start documenting the rash by taking pictures and also going to the doctor to establish a pattern. If you can not afford an attorney you could involve the Department of Social Services. If they are convinced a safety issue exists they have the power to seek a court order on your behalf. Be advised - DSS can turn on you as well as your ex. So make sure all off your ducks are in a row before involving DSS.
