Legal Question in Disability Law in North Carolina

Type your question here. Type your question here. In May of 2012 I was transferred to a different department at work. I work in a hosiery factory.

After 2 months I started having a lot of upper respiratory problems, dizziness and feeling

generally unwell. There is a wall directly behind my

table I work at that had a dary grey to black flim on it. I started to suspect a possible mold allergy as my health continued to get worse. I notice walking long distances I started having labored breathing and wheezing. I told my superiors I felt my healh had gotten worse from a possible mold allergy. I was ignored and told they really didn't know whst could be done. There was mold growing on wooden palates and racks also because of water and

moisture issues that had been neglected. As I got increasingly worse this past Oct 2013 I saw a specialist which did diagnose me with severe

Asthma and mold allergies. I have always had allergies but nothing ever to this degree. I am now on 4 new meds with intermittent Predisone to try and conteol my Asthma. They weren't working. I have greatly lost quality of life and have been out of work since Sept 29th. My Doc wanted me to start Xolair injwctions to better help my chronic severe Asthma. They are helping but still not where I'd like to be as far as work ready. I am scheduled to return to work on Dec 1rst this year. I have been shamed and treated ugly by my co- workers for suggesting calling OSHA back in Oct so I never called them. The company hasonly cleaned the vack wall, but has done nothing about mold in other places nor teied to remedy the moisture siuation in the entire

Mill. So far I am the only one that is sick but I suspect the whole Mill is contaminated with mold as they moved me to another department away from the initial contamination. I worked one day in the new area and was sick with severe breathing issues for 3 days. I do have problems when outside also, but they can't legally discriminate against me because I have Asthma whether it was caused by exposure to mold there or elsewhere can they? Also, since I got worse while working there aren't they responsible for provding myself and my co- workers a healthy environment in which to work in?

If I can't tolerate working without getting sick what should be my next course of action? I have signed up for short disability but have not received it yet.

I have been without pay since Sept of this year. The Xolair shots are supposed to be my saving grace my Doc believes once I get enough of them. I have only had one so far.. So I need some legal advice if I can't work for getting sick when I go back. I'm at a loss as what to do. Any legal advice would be greatly appreciated. Thank you in advance!

This is a very sad and complicated matter. You need to consult a worker's compensation attorney for assistance.
