Legal Question in Bankruptcy in North Carolina

Automatic stay

I am going through divorce process. I just got a notice that my spouse is filing a petition pursuant to 11 USC section 362- automatic stay. What does this mean? I'm trying to get spousal support and my 1/2 of the house...Is this an attempt to stop the divorce court from giving me my just dues? I am the only listed party... will this stop my spouse from having to pay me for my 1/2?

You should go to the bankruptcy court and request permission to continue your action for support.

I strongly urge you to have a lawyer represent you in the bankruptcy case to protect your rights.

If you have a lawyer in your divorce case, aske him or her to help.

If you cannot afford a lawyer, try your local legal aid society. Most bar associations also have panels of lawyers willing to help for reduced fees.
