Legal Question in Bankruptcy in North Carolina

Lien on Car Title after Bankruptcy

We converted our Bankruptcy from a Chap. 13 to a Chap.7 which was discharged nearly 4 yrs ago. Some how our car got listed under the chap. 7. We didn't make payments on it and the credit company never attempted to repo it. Is there any way to get my the title clear? Please help, I need a car to drive again. Thanks.

Re: Lien on Car Title after Bankruptcy

It's hard to give concrete advice here because there are some unanswered questions. What do you mean when you say that the car "somehow" how listed in the chapter 7? It sounds like the car loan was discharged in the chapter 7 if you never made any more payments on it, but I can't be sure from your description. If the loan was discharged, the car should have been surrendered to the lender to satisfy their lien. At this point, the only way to get the title from the lender would be to work out some arrangement with them, which would probably involve paying them some money.

But again, this is guesswork on my part, because I am not sure of all the facts. I recommend that you consult a qualified bankruptcy attorney.
