Legal Question in Bankruptcy in North Carolina

If I owe 86000 on house and valued at 2000000 can keep as homestead in NC,? What about cars for married couple?

I will assume that you meant $200,000.00 as in Two Hundred Thousand as opposed to the $2,000,000.00 as opposed to Two Million dollars you listed for the value of the home.

First...you need a bankruptcy attorney with either values for a home, you CAN"T afford to do this alone. With either number you have too much equity to protect and your home would be sold. Under NC law, you are allowed to protect $35,000 in equity each for a total of $70,000 in equity. You have $114,000 in equity which is about $44,000 over the homestead exemption.

And as for cars, an evaluation of the value, ownership, and liens of the vehicles would be necessary to give a proper answer. Consult with an attorney immediately.
