Legal Question in Bankruptcy in North Carolina

Is there such a thing as "Medical Bankruptcy"?

One of my clients is asking a foundation for help with bills and they told her to check into Medical Bankruptcy, but I cant find such a thing. My client filed regular bankruptcy 10 years ago. She has many medical bills, credit card, and car loan. Her only income is Social Security Disability, she is 54 years old.

Re: Is there such a thing as

The Statute of limitations for filing a new chapter 7 bankruptcy is six years. She can file now. I have never heard of a special catagory of medical bankruptcy. For those out there who have filed a chapter 7 bankruptcy within the last 6 years and now find they need to file again the law allows for the filing of a chapter 13. In order to qualify you must have disposable income which means having income in excess of your necessary expenses sufficient to pay the costs involved and, of course something for creditors. There is no requirement that creditors be paid in full.
