Legal Question in Consumer Law in North Carolina

I suffer from a silverware phobia or argyrophobia I cam not eat from or wash silerware it weird but I can't control it my friend and I went to dine they took my order I ask for plastic they stated I could not eat in my friend explained I couldn't control it and they stated they were sorry we had to get our food to go it was upsetting and they gave ud plastic ware in our go bag I felt violated I have a right to dine in no matter my persnal phobia and they had the means to fix it

This is a very good question. This will come down to the severity of your disability along with how recognized it is and the ability of of the restaurant to reasonably accommodate you.

Unless there is some health code rule against it( I doubt this) then restaurant could have given you plasticware as they had it.

The key is whether your condition is recognized as a disability. If it is, they have unfairly discriminated against you. If it is not, then unfortunately, they can legally behave as they did.
