Legal Question in Credit and Debt Law in North Carolina

I live in North Carolina. I have Chapter 7 on my credit until 2020. I have high credit card debt, that due to a decrease in income of 12,000 - 14,000 per year, I cannot pay. What would happen if I just stopped paying this unsecured credit card debt?

Just not paying is not a plan. You cannot refile bankruptcy for 8 years and get another discharge under a chapter 7. Th eight years is measured between when you filed for the last bankruptcy and when you re-file. Who is the debt with? If you stopped paying, creditors would have 3 years to sue you again. Depending on who the creditors are, I might take a wait and see approach. If you stopped paying, start saving up the money as you can. If you are sued, you can then try to settle the debt. Unlikely that all creditors would sue. However, you need to really have an in-depth consult with an attorney like me to review your situation - assets, debts and come up with a game plan for you.
