Legal Question in Criminal Law in North Carolina

15 charged with larceny

My niece was arrested as a juvenille for shoplifting. She was sentenced to 5 days detention or 4 months probation.she chose probation. she violated probation and did her 5 days. Can she still be on probation even though she did the 5 days as time served. This was her 1st offense and I'm praying her last.her probation officer says they are going to put her in juvinelle detention center for 12 days for this same charge. She did not commit a new crime. How can they keep punishing her for the same crime?Any help would be greatly appreciated.

Re: 15 charged with larceny

Usually, once you have served the alternate sentence you are released from custody, including probation. In your niece's situation, if she is in family court instead of criminal court, the court has further discretion than criminal court.
