Legal Question in Criminal Law in North Carolina

2nd degree trespassing

I was invited to my brother's birthday party on May 14 2006. Everybody was drinking. Me and my husband had an argument. My brother told me to leave, but I didn't have a ride, so he called the law. When the law arrived my brother told him not to arrest me, but I was upset at my brother, so I told the cop to go ahead and take me in. I was charged with 2nd degree trespassing. I got out of jail that night on a $300.00 bond. I have court May 19. My question is, if the charges are dropped, will I have to pay a fine other than court cost? Also, will my brother have to be in court?

Re: 2nd degree trespassing

Generally, your brother would need to be in court to establish that you did not have consent to be on the subject property. If the case gets dismissed, I don't think you'd have to pay any fines or court costs.
