Legal Question in Criminal Law in North Carolina

My mom and and I got into a small fight. The police were called and even though i said repeatedly I didn’t want her arrested or to press charges on her, they arrested her anyways and charged her with a misdemeanor Simple Assault. How do we go about getting these charges dropped?

Don't wanna get arrested and prosecuted - don't involve cops in your business or don't be so obnoxious that other people call the cops on you. As to getting the charges dropped, much in the same way you had no control over the arrest - you have no control over whether the charges are dismissed. That is up to the ADA exclusively. You can certainly politely ask the the ADA consider dropping the charges but ultimately that is up to the ADA. Most cops and ADA's are sick and tired of people crying wolf over or being obnoxious enough to cause other people to call the cops over as you put it a 'small fight' and wasting valuable police and court resources and manpower because you got angry and couldn't control yourselves. Hopefully they will not drop the charges and will make an example of you and you mother so you two don't do this sort of trifling petty crap again in the future - unless of course, it is actually necessary.
