probation transfer after extradition

My fiance was recently extradited to NC from VA for a 7 year old felony charge. He was found guilty and placed on one year probation. Now his NC probabtion officer is refusing to ask for probation transfer back to VA. Is this legal?

Of course, but this probation officer's decision may not necessarily be final, and the defendant would likely be well advised to seek the advice of the N. Carolina attorney who hopefully represented him in the matter which caused his extradition as to how he should now best proceed in getting this decision reversed.
