Legal Question in DUI Law in North Carolina

My son is 18 and was intoxicated and detained by local police and cited for "Consume an alcohol beverage while less than 19 years old" (Nc G.S. 18B-302(B)(3)) He was in a vehicle and the driver was another 18 year old who got a DUI.

First offense, starting college in 5 days. How best to proceed in order to have it expunged in the future?

Thank you for writing. A conviction could impose a fine, probation, treatment, community service and/or even imprisonment for your son. Since this is your son's first offense, we may be able to negotiate a much better situation for your son, depending on the county where the offense occurred. Did your son blow into a machine, either on or off the road and what was the result? Please call me at 919 302-8271 and we can discuss this further.
