Legal Question in Family Law in North Carolina

adultery

we both live in same household with two children and i just found out he has been doing a dating service and has had sexual relations with quite a few people while we have been married. My question would be that i can't afford to move out. |What are the circumstances for filing for bed abd board and do i have to request this to get them to make him move out of the house? Also, house long does that take? I have proof.

Re: adultery

If you sleep with him after you have knowledge of the affair, that may constitute a legal forgiveness of the adultery called "condonation."

You can file an action for divorce from bed and board based on adultery. A judge can order him to leave the house if a divorce from bed and board is granted. Some judges are reluctant to order this, however, even if a divorce from bed and board is granted (but that is one purpose of it).

You could also leave and bring an action against him for everything (child custody, child support, post separation support/alimony, etc.)
