Legal Question in Family Law in North Carolina

My Attorney Withdraws 28 days before my Trial

My attorney Withdrew from my support modification case 28 days before my case was to be heard citing Irreconcilable differences on his part, I was unaware of any Differences on my part I simply emailed him asking for a trial status My attorney whom I gave my Retainer Fee never kept me informed or returned my email's or Call's for his tenure as my attorney, As it stands now I have no attorney and my only options are Pro Se I am unable to obtain counsel on short notice and finances and the Trial is in less than 27 days after Christmas. What options do I have other than accepting his withdrawal and filing a complaint against my attorney with the NC Bar association on ethics violation but it still leaves me without representation

Please Help me with advice..

I don't think withdrawing one month before a trial is an ethics violation, at least in Florida. You may be wasting your time and energy on the complaint. As for the trial, obviously, you can find other counsel. Once you do, he or she can ask the court to push the date back if you get a\the new lawyer really close to the date. Or, you can ask the court yourself and then look for new counsel. Good luck.

I agree with the other attorney who replied to you. You can ask the judge for a continuance (that is, to postpone the trial) because you need a little more time to find a new attorney. This is likely to be granted. Good luck!
