Legal Question in Family Law in North Carolina

Conditions under which child support can be lowered

My boyfriend has a good paying job and pays, what I believe to be, a rediculously high child support payment. When the support was set, he was told that, even if he were to quit his current job, the child support would not be lowered. My question is basically whether this rule is set in stone or if there are exceptios. My boyfriend's job includes aspects that are damaging his health. This can be medically proven. He fears, however, that, should he quit this job, he would not be able to find one that pays as well. He could not maintain his current payment at a lower paying job. Under a condition such as this, would the court consider adjusting the payment to a new job's pay?

Re: Conditions under which child support can be lowered

Your boyfriend cannot wilfully quit his job just to lower his child support obligation. However, if his health is failing due to his current job he can likely plead a significant change of circumstances. In this case a switch in jobs with a lower salary would be taken into consideration when he asks for a modification of payments. No-the rule is not set in stone.
