Divorce and spousal support

In the state of N.C. is there a certain amount of time a couple has to be married for one to collect spousal support? How long is that time? Is the year of legal separation counted as part of that time?

No, there is no set amount of time, and the year of legal separation would not be included. I generally tell people that if they have been married less than 3 years, the chances of getting post-separation support are very low. There are many factors that the judge would take into account, such as the spouses' relative financial conditions, educational/work backgrounds, misconduct during the marriage, financial needs, etc.
