Legal Question in Family Law in North Carolina

i was married in rockingham nc in december of 2005 we separated in march of 2006. we never recieved a marriage certificate and I can find no record of our marriage anywhere. I don't have the money for a divorce. And I also have NO idea where to find him. I have called his relatives and no one knows how to get in touch with him. I was just wondering since we were married for such a short time and separated for years does that mean anything??? Oh and the reason for our separation was spousal abuse on his part. I had him locked up in march of 2006 and have not seen him since.

You first need to determine if you were legally married. There should be a record of the marriage in the county you were married in. Second, divorce is fairly cheap usually in the $375 range. However, since you can't find your husband, you will also have the added expense of having to do a legal publication if you do decide to divorce. Finally, if you were legally married, the only thing that being married for a short period of time over six years ago means is that you are now possibly eligible to file for a divorce. Spousal abuse is also irrelevant. Of course, if it turns out you were never legally married, you don't need to do anything.
