Legal Question in Family Law in North Carolina

paternal rights-- abandonment

I left my husband because of abuse and drugs. I left the children there with him susposed to be until school was out. He is trying to keep my children away from me and charge me with abandonment. I want us both to have joint custody. It has been almost two months since I left. He want let the children come to where I am. Since neither of us have legal custody of the children what can I do. I don't want anything from him except my children or visistation to them.

What can I do to ensure that my rights are not revoked as their mother and so that I won't have to end up pay this man child support. He hasn't had a job in two years.
