Legal Question in Family Law in North Carolina

Sibling would like custody

My half-sister is 12 years old. Our mother is unfit, has been in jail for various

things and was given only visitation custody for our sister. She has multiple

misdemeanors and one or two felonies. She is currently on probation and

house arrest.

My sister's father, my ex-step father, is dying in hospice as we speak. He did

not make any legal arrangements at all. My brother and I dont know what to

do next. Either of are happy and eager to have her.

How likely is it that my brother or myself can gain custody of my sister? WIll

my mother have any rights once my step father dies?

Each Tn county may handle this differently. However, I think this child can be declared dependent and neglected by her parents. I think that an adult sibling would be a fine candidate for custody. Please find a local lawyer and speak to him or her about it.
