Legal Question in Civil Litigation in North Carolina

My girl had put down $1500 on a car at a "buy here pay here" dealership last Friday she drove it that day but last Saturday it wouldn't run so we took it back this past Tuesday and so we asked for our money back and they said we couldn't get it back since they have there car shouldn't we be able to get our money back?

The short answer is likely no. Your girl most likely bought the car 'as is' with no warranty. If that is the case, she is basically for lack of a better word - screwed (and not in the good way). Further, you referred to the car as "their car" implying that you left it there. No, no, no it's likely her car (at least for now), if she left the car there here is what is likely to happen: they are likely charging you storage fees daily and if you don't pick it up, at some point they will apply to DMV to have the title put back in their name, fix it up a bit and re-sell it and to top it all off, likely pop her with a judgment for the balance plus fees and expenses - which they will likely collect out of her tax return (or some other source) if she was expecting one. This likely isn't the answer you were looking for but buying a car ain't like buying a toaster at K-mart. To be one the safe side you should consult with a local attorney but if her paperwork says "as is" the odds of any better out come are less than slim and none.
