Legal Question in Insurance Law in North Carolina

no life insurance

My husband passed away on Jan 31,2005. I assumed I had a life insurance policy on both him and myself through my employer. I called and employee of the company to check on the policies. I was told there was not one on my husband nor myself. I have been an employee of this company for almost 20 years. After 10 years the company paid for my insurance. I called the first company our policies were with and was told they had lapsed in 1992. The next company was changed a few years ago to blue cross and blue shield, it was at this point that i suddenly had no life insurance coverage. During this transition the only thing i was asked to fill out was a questionnaire concerning illnesses and medication i was taking. It had not even been decided at that time that blue cross would become our insurer.But once it was in effect, I assumed that the company was still paying for my life insurance. I received no notification that I would have to sign anything to have my life insurance re-instated. After bringing this problem to their attention, they assured me that the problem would be corrected, a little late to help me but other employees might be helped. My question is who was responsible for my not being covered, my employer?, insurance rep ?

I think it is worth exploring in much more detail. I would explore the possibility of recovery under an errors and omissions policy as well as from your employer. If you were given an employee handbook, I would want to review that document along with any summary plan descriptions for all benefit plans.
