Legal Question in Insurance Law in North Carolina

Prayer of Judgement for a traffic violation

I received a ticket for ''Unsafe Movement'' after I pulled in front of an oncoming vehicle. There was approximately $8,000 in total vehicle damage. The investigating officer said I could take the ticket to court with a letter from my insurance company stating all was settled. The ticket would then be dismissed. What does that mean? Will my insurance still go up?

Re: Prayer of Judgement for a traffic violation

many District Attorney's will dismiss upon the presentation of a letter from your insurance company stating they have or will settle all claims arising out of the incident. Accordingly, you will not have insurance points assessed to you for the ticket and your rates do not go up as a result of the ticket. HOWEVER, YOUR INSURANCE COMPANY CAN AND WILL STILL RAISE YOUR PREMIUMS BECAUSE OF THE ACCIDENT ITSELF (NOT THE TICKET). GIVEN THE AMOUNT THAT THEY WILL PAY OUT TO THE OTHER DRIVER FOR PROPERTY DAMAGE ALONE, YOU WILL HAVE 3 INSURANCE POINTS ASSESSED AND YOUR RATES WILL GO UP SUBSTANTIALLY. SORRY, THERE IS NO WAY AROUND THIS.
