Legal Question in Employment Law in North Carolina

I applied for an advertised job for which I am qualified and received a response asking me to indicate race and gender or else my application would not proceed any further. I responded with my race and gender and subsequently received a message that the position is no longer available. Is this legal for the prospective employer to do and what steps can I take for this apparent discrimination?

Generally, your employer cannot ask questions about your race during an interview. However, your employer may need information about your race for affirmative action purposes or to comply with government laws that require the reporting of race information. If you believe you did not get the job because of racial or gender discrimination, you should contact your local EEOC office to file a complaint.
