hospital fall

81 year old male in hospital, had parkinson disease. aid left alarm off patient after feeding, patient climbs out of bed,falls and creates bleeding of brain. before fall...walks, feeds himself bathroom with minor help. After fall none of the above, advanced apperance of parkinson after fall per doctor,. Fell Jan 5 2009 death Feb27,2009 ..no autopsy.. hospital wants to know what we woud consider as just compensation... would you suggest ball park figure. family does not want to sue

This is a good question. You really need professional guidance on this, with much more information. I would suggest that you try to find an attorney in your area to meet with you to discuss this. You may be able to obtain a free consultation. Or, even paying hourly for the advice will be well worth the investment. If the hospital is approaching you regarding just compensation, then they probably realize their liability. Claims for wrongful death often settle in the hundreds of thousands of dollars, but ever case is different. The advanced age of this patient (and presumably the lack of income) tend to render the value lower, but nevertheless claims for wrongful death are significant. If you cannot prove wrongful death, then you at least have a claim for the symptoms caused during this time span. A lawyer can also help to address the causation issue.
