Legal Question in Medical Malpractice in North Carolina

Failed vasectomy

My husband had a vasectomy in Ocotober of last year. He submitted his first sample in December and the second one in March. Both samples came back with a 0 (zero) sperm count, and my husband was considered sterile. However, two weeks after the second sample I got pregnant.

Do we have any legal options?

Re: Failed vasectomy

If the doctor failed to follow the "standard of care," then you probably do have a claim. If you can meet this proof, then the doctor would be liable for the hospital and medical expenses of the pregnancy, pain and suffering connected with the pregnancy, and lost wages, but would not include the costs of rearing the child. You probably want to consult with a lawyer with more details.
