Legal Question in Medical Malpractice in North Carolina

My son was taken by the Police to a Mental Health Facility in N. Carolina. He had written a 12 page goodbye letter and was over dosing on over the counter pills. I know each state has different baker act laws but when you are a danger to yourself I thought it was an atomatic 72 hrs. They were given copies of the letters told what he had taken that they knew off and also were told he had a prior attempt yrs prior. They let him out the next morning and within 2 weeks he hung himself. If he wasnt a threat to himself what does it take??? can you help. I live in Fl. this happened in N. C. He hung himself in Gainsville where he had gone to UF for 5 yrs.
