Legal Question in Personal Injury in North Carolina

Grocery Store Injury

I turned to pay the cashier at a grocery store and my four year old pulled on

the side of our cart causing it to fall over onto another shopper that was in

the line beside of us. The lady was bleeding from the ankle and the

ambulance was called. I gave my name and number to the store manager.

Will we be finically responsible for injuries of this obvious accident or will the

store's lliability insurance cover?

Unless your child had a history of this behavior, you would not be liable. The store is not liable. This is basically an "accident" in which no one is at fault. (The minor is deemed incapable of negligence at that age.) The store may have a "med pay" insurance policy that would pay for her medical bills.
