Can I ask a insurance company of the person that hit me and my girlfriend in the back to make the check of the amount of my er visit to me and me pay the hospital as I see fit being I didn't file it under any insurance

Sometimes they will pay you directly and sometimes they will not. It depends in part on whether the hospital has asserted a lien against the recovery. There are ways that an attorney can assist to shift a lot of the settlement to you, rather than having most of it go to the hospital.
