Legal Question in Personal Injury in North Carolina

Negligence

An electrical outlet was removed from the floor, left unfilled, and covered with carpet. On 2/9/09, my high heel penetrated the carpet into an unfilled hole in the floor at work. I tore a ligament in my right ankle. I am going through physical therapy 3 times a week. I work for the State of NC.

Do I have a negligence case against the company that installed the carpet or the State of NC?

Re: Negligence

If I understand the facts correctly, you work for the State, and therefore your claim against the State would be limited to a workers compensation claim. You also likely have a claim against the people (contractor) who actually did this work. There is a tricky interplay between that negligence claim, and your workers compensation claim. You may want to consult with an attorney and provide him or her more details to discuss this issue further. Please let me know if I can be of any assistance.
