Legal Question in Personal Injury in North Carolina

Rearended yet they dont want to pay

I was rearended while at a stoplight, even though not much damage was done to car, I am still under Dr care. The Lady that hit me is married to a personal injury lawyer, agrees it was her fault, yet feels like they shouldnt be responcible for medical bills and wants my medical info and life history dating back 13 yrs, I am 32 and 3 yrs later still in pain and go to pain management.

Re: Rearended yet they dont want to pay

First, you should probably be dealing with their insurance company, and not with them directly.

Second, they don't have to settle with you, and you don't have to provide them with any records; all of that is voluntary. An insurance company might want to see some of your prior medical records also, but probably not 13 years. Your only option if they won't settle (or if they make an unreasonable demand for your records) is to file suit.

Third, the statute of limitations is three years for this type of claim. If three years have passed since the date of the accident, then you really have no rights.

You probably need to consult a lawyer.
