Legal Question in Personal Injury in North Carolina

slip and fall on ice at a nursing home

Hello,

This past January during the ice storm I paid a visit to a pt in a nursing home. I slipped, fell,& hurt my left arm badly. I went into the facility, reported the accident, &they brought me an ice pack. A nurse & PT also attended me. I stayed there for about an hour. And they did complete an injury form. I did not go to the ER because it was clear I did not have any broken bones. But almost 3 months later I still have pain. Is it too late to pursue a claim? Thanks for your advice.

It is not too late, but action should be taken soon. You should be aware that NC is one of only a handful of states that still has contributory negligence as a defense which could bar any recovery.

You may wish to file a claim with the insurance carrier for the nursing home for the medical bills. Many policies have a no-fault medical payments provision.

Good luck.
