Legal Question in Personal Injury in North Carolina

vandalism/injury to personal property

if a person is riding in a car with someone that is throwing nails out of a window (and this is not the first time) and the person throwing the nails is now in Iraq and can't be reached, would the other person in the car be responsible for damages done since they knew it was illegal and did nothing to stop him?
