Legal Question in Real Estate Law in North Carolina

Clearing of Land without Permission

What should be done legally in the following situation?

Land was granted, through a will, to a person about 4 years ago. A resident adjacent to this land recently gave permission to a company to cut down all the trees that were on his land. The resident of the adjacent land told the company that all the land was his land and the company failed to find out that 12 acres were not his land but belonged to the first individual mentioned. The company proceded to cut down the trees on the 12 acres and the owner of this 12 acres did not give permission.

Re: Clearing of Land without Permission

You should retain an attorney to look further into this. If the land, by will, has been properly recorded to put the tree company on notice that the other owner did not own the land, the tree company is likely liable for damages. Also, if the other owner DID inform the tree company that he did own all the land, he may also be liable. Bring them both in. This is something that an attorney should look into and bring the appropriate type action for damages.
